OSHA suspends vaccine mandate, LJC says ‘it was egregious’ for White House to advise people keep following mandate

WASHINGTON - Adhering to a recent court ruling, OSHA has suspended the enforcement of mandatory jabs for the private sector. 

On Friday, the Fifth Circuit Court of Appeals found OSHA’s Nov. 5 mandate requiring employees of covered employers to undergo COVID-19 vaccination or take weekly tests and wear a mask “violates the constitutional structure that safeguards our collective liberty.”

In addition to granting an extended stay, justices ordered that OSHA take no steps to implement or enforce the emergency temporary standard (ETS) until further court order. 

“While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation,” states a posting on the agency’s website.

Following the Fifth Circuit’s ruling, the DOJ said it would “vigorously defend” the mandate. The Biden Administration has been pushing for enforcement of vaccine requirements for the past three months. 

The ruling was in direct response to the request for an extended stay filed by the Liberty Justice Center, along with the Louisiana-based Pelican Institute for Public Policy.

“It was egregious for the White House to advise people to continue following the mandate after our first suspension, and we’re glad to see the federal agency now acknowledge that the rule is on hold,” said Kristen Williamson, a spokesperson for LJC. 

According to its website, LJC fights for the constitutional rights of American families, workers, advocates and entrepreneurs.
