Affirmed on appeal: Houston Pension System’s summary judgment win in suit against city

HOUSTON - Today, the 14th Court of Appeals affirmed a summary judgment win in favor of the Houston Municipal Employee Pension System. 

The litigation is a dispute between the Pension System and the city of Houston. 

The Pension System sued seeking to compel the city to make payments that it contends are statutorily required, court records show. 

The Pension System also asserted ultra vires claims, which are claims alleging that public officials are refusing to do something that they should. In response, the city asserted counterclaims. 

Court records show the trial court denied the city’s plea to the jurisdiction and granted the Pension System’s motion for summary judgment. 

“Here, the City Parties have challenged only the Pension System Parties’ grounds for traditional summary judgment on the City Parties’ affirmative defenses, counterclaims, and third-party claims,” the 14th Court’s opinion states. “Because they have not challenged the no-evidence grounds for summary judgment on these subjects, we overrule these sub-issues, and thus, we overrule the entirety of the City Parties’ issue challenging the summary judgment.

“Having overruled the two issues that survived for our consideration, we affirm the trial court’s judgment.”
