Worker alleges unsafe ladder caused is 12 foot fall

HOUSTON — A worker alleges he fell down 12 feet due to an unsafe ladder he was provided to service an ice machine on the roof of a restaurant. 

Michael Reed filed a complaint Nov. 19 in Harris County District Court against Honeybee Foods Corporation also known as Jollibee and Kensinger Properties Limited alleging premises liability and negligence. 

According to Reed's complaint, he was hired by the defendants to service their ice machine located on the roof of the Jollibee restaurant which requires him to use a ladder to access the machine. He alleges that on Nov. 4, 2020, as he was servicing the ice machine, he lost his balance and fell back down 12 feet and smashed into the pavement below. 

Reed claims he suffered fractures and other injuries which required surgery to his ankle and leg including having plates and screws placed. Reed claims the defendant's ladder violated OSHA standards including irregular side rails, having no skid-resistance material and was unlevel.  He further claims the defendants knew or reasonably should have known of the condition the ladder which was the only ladder leading to the roof and failed to warn him of the hazard.

Reed seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Anthony Foster and Russell Briggs of Fibich, Leebron, Copeland & Briggs in Houston.
