Couple alleges builder negligently construction home's foundation

HOUSTON — A couple allege their home's foundation was not properly constructed due to the builder's negligence.  

Russell Morris and Dana Morris filed a complaint Nov. 30 in Harris County District Court against Legend Classic Homes LTD doing business as Princeton Classic Homes and Home of Texas alleging negligence and other claims. 

The plaintiffs purchased a home on Maroneal Street in Houston in 2015 which was originally purchased in January of 2013 from Legend Classic Homes. They claim that the sale included a transferable warranty and that upon inspection of the home in December of 2019, the property showed signs of distress and dis-elevation. 

The plaintiffs also claim that in March of 2021, an inspection found the home's foundation had failed which also caused needed repairs to the sewer, gas, water lines and flooring replacement. The plaintiffs allege the defendants failed to construct the home in a good workmanlike manner and to "regularly accepted construction practices" and did not properly supervise the installation of the foundation. 

The plaintiffs seek monetary relief between $200,000 and $1 million, interest and all other just relief. They are represented by Carl Dawson of Ryan & Dawson in Houston.
