Refinery worker suffers injuries while trying to escape fire inside tank, suit claims

HOUSTON — A boilmaker who suffered injuries while trying to escape a tank fire at a refinery is claiming negligence. 

Jose Rodriguez filed a complaint Dec. 1 in Harris County District Court against CertifiedSafety LLC and Excel Modular Scaffolding and Leasing Corporation alleging negligence. 

Rodriguez, according to his suit was working as a boilermaker at the Marathon Texas refinery on June 13, 2020. He alleges that as he was inside a tank, a fire erupted and as he tried to escape, he fell from the top of the tank and landed on his back and shoulder. 

Rodriguez claims the defendants failed to properly monitor the refinery tank and work area, failed to warn of the dangerous condition and did not provide adequate training. He also claims the defendants failed to provide a safe workplace and violated OSHA regulations and standards.  

Rodriguez seeks monetary relief of more than $1 million, interest and all other just relief.  He is represented by Muhammad Aziz and David Baluk of Abraham, Watkins, Nichols, Agosto, Aziz & Stonger.
