McDonald's drive thru customer alleges unsecured lid caused hot coffee to spill, sues for $1M plus

HOUSTON — A woman alleges she suffered injuries after the lid on a hot cup of coffee was not properly secured at a McDonald's drive thru in Houston. 

Charity Poku filed a complaint Dec. 2 in Harris County District Court against Quijano Management alleging negligence. 

Poku was using the drive thru window at the McDonald's restaurant on West Holcombe Boulevard in Houston on Oct. 28, 2021, according to her suit. She alleges a McDonald's employee handed a hot cup of coffee to her with an improperly secured lid and when she attempted to drink the coffee, the lid "broke free from the cup" and caused "scalding" hot coffee to spill on her. 

Poku claims the defendant's negligence for failing to prepare and package the coffee and not serving the hot liquid in an adequate container to prevent spillage. She also claims the defendant was negligent for failing to supervise and train its employees and to properly implement safety procedures. Poku also claims the defendant did not warn of the dangerous condition and ensure quality control.

Poku seeks monetary relief of more than $1 million, interest and all other just relief. She is represented by Marcus Spagnoletti and Eric Rhine of The Spagnoletti Law Firm in Houston.
