Baylor College of Medicine, physicians face wrongful death claim

HOUSTON — Baylor College of Medicine and two physicians are facing a wrongful death suit after a patient's failed heart surgery. 

Juanita Espinoza, on behalf of all wrongful death beneficiaries and as personal representative of the Estate of Eusabia Casarez, deceased  filed a complaint Dec. 7 in Harris County District Court against Kenneth Liao, M.D., Jose Diez, M.D., and Baylor College of Medicine alleging wrongful death and gross negligence. 

According to the plaintiff's complaint, Eusabia Casarez underwent a mitral valve replacement on Sept. 8, 2021, performed by the Liao at Baylor College of Medicine in Houston with Diez clearing Casarez for the surgery. 

The plaintiff claims that both the clearance and procedure of Casarez's surgery were "below the standards of care" which caused Casarez to suffer permanent and disabling injuries and death. The plaintiff further claims the defendants were negligent in the care and treatment of Casarez which resulted in the failed mitral valve procedure and her death. 

The plaintiff seeks monetary relief, interest, trial by jury and all other just relief. She is represented by James Edwards and Kenneth Nguyen of The Law Offices of Jim Edwards PLLC in Houston.
