Woman alleges hotel owner's failure to properly mark curb caused her fall, sues for $1M plus

HOUSTON — A woman alleges a hotel owner's failure to properly mark a curb caused her fall and injuries. 

Janice Underwood filed a complaint Dec. 5 in Harris County District Court against Westmont Hospitality Group Inc., and Westmont Hospitality Management LLC alleging premises liability. 

Underwood, according to her complaint, was at the defendants' Hotel ICON on Main Street in Houston on Dec. 31, 2020. She alleges that as she was walking to the hotel parking garage, she fell to the ground as she stepped over a curb that had been painted jet black and camouflaged that made it difficult to see the elevation change. 

Underwood claims that the sudden change in elevation would have been seen if the curb had been painted a bright color or had noticeable markings. She also claims the condition posed an unreasonable risk of harm and that the defendants failed to exercise reasonable care to warn of the hazard. Underwood alleges she also suffered disfigurement, impairment and incurred medical expenses as a result of her fall.

Underwood seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Alan Kolodny and Rashon Murrill of The Kolodny Law Firm PLLC in Houston.
