Construction worker claims negligence after being hit by falling debris from trash chute

HOUSTON — A construction worker claims the failure to barricade the trash chute he was repairing caused him to get hit by falling debris.

Russell Bell filed a complaint Dec. 17 in Harris County District Court against Greystar Development and Construction, CRP/AR Heights Waterworks Owner, LP, John Doe and others alleging negligence. 

Bell, according to his complaint, was working as a subcontractor for Greystar on a construction project in Houston. He alleges that as he was working on repairing the trash chute and the associated scaffolding, John Doe dropped sheetrock and other construction materials 40 to 50 feet down the chute which was out of service. 

Bell further alleges that he was tied onto the scaffolding and was unable to avoid the falling debris which struck him in the neck and shoulder. He claims the defendants failed to barricade the trash chute, instruct workers at the site that the chute was in service and failed to warn of the falling materials. He also claims the defendants did not have or implement adequate safety protocols or provide a safe workplace. 

Bell seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Joshua Lee of Armstrong & Lee LLP in Houston.
