HOUSTON — A man alleges Speedway Loans illegally seized his vehicle and defaulted on their loan contract agreement.
Clarence Gibson filed a pro se complaint Dec. 2 in Harris County District Court against Speedway Loans Ins., alleging violation of the Texas Business and Commerce Code and other claims.
According to Gibson's complaint, Speedway Loans was four days late in issuing his car loan which they had promised would be "delivered in 10-15 minutes" and which was advertised as "same day funding." He claims that the defendant did not answer any more calls until three days later in violation of the Texas Business and Commerce Code and retracted its first month free promotion while charging him double the debt.
Gibson also claims Speedway Loans gave him only three days to cure his default and that he contacted them in regards to the selling of the vehicle for $30,000 against a $7,000 loan and was falsely promised a refund. He alleges that the vehicle was paid off and that "an affiliate" of Speedway kept the vehicle for themselves.
Gibson seeks monetary relief of $500,000 and all other just relief.
