Woman alleges she was struck by falling shelf while shopping at Macy's, sues for $1M

HOUSTON — A woman alleges she was struck by a falling shelf while shopping at Macy's at Willowbrook Mall in Houston. 

Ana Varela filed a complaint Jan. 4 in Harris County District Court against Macy's Retail Inc., Macy's Retail Holdings Inc., and Macy's Retail Holdings LLC alleging negligence. 

Varela was at the Macy's store at Willowbrook Mall in Houston on Feb. 14, 2020, and alleges that while shopping, a shelf fell and struck her and caused her to suffer "serious and permanent" injuries. 

She claims Macy's negligence for failing to maintain its premises in a reasonably safe condition, failing to inspect its premises and failing to correct the dangerous condition. 

Varela also claims Macy's failed to warn of the dangerous condition and negligently hired, trained and supervised its employees. She alleges that as a result of the shelf striking her, she suffered impairment, mental anguish, loss of earnings and incurred medical care treatment costs. 

Varela seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by John Vong, Amy Williams and Cindy Phan of the Law Offices of John Vong PLLC in Houston.
