Suit: Scrap metal lands on man's head at recycling facility

HOUSTON — A man who suffered severe injuries after a large piece of scrap metal fell on his head at a metal recycling plant is claiming premises liability. 

Marcelo Hernandez filed a complaint Jan. 6 in Harris County District Court against South Side Scrap Metal LC alleging premises liability. 

Hernandez, according to his suit, was at South Side Scrap Metal's property on March 12, 2020. He claims that while he was unloading his trailer for recycling, a large piece of scrap metal that was being swung over him by a machine dropped on his head and caused him to fall. 

Hernandez alleges that South Side Scrap Metal failed to warn him of the unreasonably dangerous condition and failed to make its premises reasonably safe. Hernandez claims the defendant knew of the risk of harm that was foreseeable and unreasonable. 

He also alleges as a result of the accident, he suffered mental anguish, pain, impairment, lost wages, disfigurement and incurred medical expenses.  

Hernandez seeks monetary relief between $200,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Michael Pierce and Eduardo Garza of Pierce Skrabanek PLLC in Houston.
