Family Dollar customer alleges leaky water bottles led to her slip, fall

HOUSTON — A Family Dollar customer alleges a package of leaky water bottles caused her slip and fall. 

Evie Smith filed a complaint Jan. 18 Harris County District Court against FD Aldine Bender LLC doing business as Family Dollar #07621 alleging negligence. 

Smith was at the Family Dollar on Aldine Bender Road in Houston on Sept. 1, 2020, according to her complaint. She claims that while at the store, she slipped on a "clear liquid" that was leaking from a package of water bottles and lost her balance and suffered serious injuries. 

Smith alleges the Family Dollar store floor was not slip resistant, that the area was not properly maintained and that there were no warning signs. She further alleges Family Dollar did not inspect the premises or take measures to safeguard invitees on the premises. 

Smith also claims Family Dollar's negligence for failing to correct the condition and that employees of the store knew or should have known of the dangerous condition. She alleges as a result of the accident she suffered impairment, disfigurement, lost wages and incurred medical care costs. 

Smith eeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Pavel "Paul Savinov, Sarah Y-Nhi Huyhn, Michael Al Varez and Stephanie James of The Huynh Law Firm PLLC in Houston.
