Customer alleges defective stairs at Houston restaurant caused her fall

HOUSTON — A customer alleges defective stairs caused her fall at a Houston restaurant. 

Jakayla Zollicoffer filed a complaint Jan. 19 in Harris County Disrict Court against Jackie & Chris LLc, Delcid LLC doing business as Little Bitty Burger Barn and Wildchild Properties LTD alleging negligence. 

Zollicoffer was at the Little Bitty Burger Barn restaurant on Pinemont Drive in Houston on May 9, 2020, according to her complaint. She claims that she suffered severe injuries from a fall due to the wooden steps she was walking down. 

Zollicoffer alleges the defendants' negligence for failing to inspect their premises, failing to warn of the dangerous condition and for failed to eliminate the dangerous condition. She also alleges the defendants falied to maintain the stairs in a reasonably safe condition and failed to take reasonable measures to protect her and other invitees to the restaurant. Zollicoffer claims as a result of her fall down the stairs, she suffered impairment, disfigurement, lost earnings and incurred medical expenses. 

Zollicoffer seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Brian Merka and Benjamin Kennedy of Kennedy & Merka PLLC in Houston.
