Woman alleges Hyundai breached warranty on defective Elantra

HOUSTON — A new car owner claims Hyundai has refused to honor the warranty on her defective 2021 Elantra. 

Nikita Guyton filed a complaint Jan. 19 in Harris County District Court against Hyundai Motor America alleging breach of warranty, breach of the Magnuson-Moss Warranty Act and other claims. 

According to her suit, Guyton purchased a new Hyundai Elantra from an authorized dealership on Jan. 23, 2021, which included a five year/60,000 mile bumper-to-bumper warranty and a 10 year/100,000 mile Powertrain warranty. She claims shortly after purchasing the vehicle, she noticed several defects including the check engine light and other warning lights coming on, issues with the battery monitor module and cable, the vehicle not accelerating properly as well as steering issues. 

Guyton also claims the vehicle's lane assist and front camera were defective along with GPS and other electrical defects which could not be fixed despite numerous repair attempts. She alleges Hyundai has failed to honor the terms of the vehicle's warranty. 

Guyton seeks monetary relief of less than $250,000, interest and all other just relief. She is represented by Adam Mott of The Law Offices of Jason S. Hegedus PLLC in Houston.
