Fuel rig worker injured while offloading diesel tank alleges negligence

HOUSTON — A fuel rig worker alleges he suffered injuries when he became pinned between a diesel tank that was being off loaded. 

Carlos Lewis filed a complaint Jan. 31 in Harris County District Court against Edison Chouest Offshore LLC, Clean Waste LLC and Galliano Marine Service LLC alleging negligence.

Lewis was working as a fuel rigger for Cajun Ironworkers at the defendants' complex C-Port on Aug. 17, 2021. He claims he and another worker were delivering a 550 gallon tote tank filled with diesel which was rigged to an overhead crane when the load shifted and pinched him in between the tote tank and the rack of the delivery truck. 

Lewis claims the defendants failed to properly train and supervise their employees, failed to facilitate a safe workplace or maintain and enforce proper safety programs. He further claims the crane operator, employed by one or more the defendants, lifted the tank when it was unsafe. 

Lewis alleges he suffered pain, mental anguish, lost wages and incurred medical expenses as a result of his injuries. 

Lewis seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Scott Armstrong, Joshua Lee, C.J. Baker, Kelly Viktorin, Aaron Bender and Adam Grable of Armstrong & Lee LLP in Houston.
