Client alleges attorney's negligence led to her personal injury case being dismissed

HOUSTON — A client alleges her attorney's negligence for failing to properly serve those involved in her personal injury claim resulted in her case being dismissed. 

Socorro Rojas filed a complaint Jan. 24 in Harris County District Court against Daniel B. Cratty and The Cratty Law firm PLLC alleging negligence. 

According to her complaint, Rojas was injured in a vehicle accident on Nov. 20, 2017. She alleges she retained Cratty's firm to represent her in her bodily injury claim. Rojas claims Cratty sent her to several doctors and specialists to treat her injuries for which she accumulated costs which Cratty told her would be paid upon settlement. 

She further claims that on the date of the statute of limitations for her case, Cratty filed her complaint, however the case was dismissed due to Cratty's failure to serve the third party driver who caused the accident. 

Rojas alleges Cratty's negligence for allowing her case to be dismissed without prosecution, failing to meet deadlines and for failing to communicate with her regarding her case and potential settlements. 

Rojas seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Kevin Forsberg of The Forsberg Law Firm PC in Montgomery.
