Homeowner alleges pool contractor failed to install paid for upgrades

HOUSTON — A homeowner alleges her pool contractor failed to install upgrades she already paid for and failed to complete the job in a timely manner. 

Sharon Mendenhall filed a complaint Feb. 7 in Harris County District Court against Palm Pools LLC alleging breach of contract, breach of warranty, negligence and other claims. 

According to her complaint, Mendenhall entered into a contract with Palm Pools on Jan. 17, 2021, for the construction of a pool at her home in Cypress. She alleges Palm Pools represented that the pool would be constructed in 90 days and that the defendants soon fell behind in the "quality and quantity" of work. 

She also alleges Palm Pools tried to charge her additional money for the multiple items that were already paid for and included in the contract such as tile/coping, concrete around the spa and bullnose tile. Mendehall claims she also paid for upgrades which were not installed including a saltwater system, pool automation and pool heater and that after nine months, the pool was still incomplete. Among Mendenhall other claims is that the defendant violated the Texas Deceptive Trade & Practices Act with its false and misleading actions.

Mendenhall seeks monetary relief, interest and all other just relief. She is represented by John Patout, Jr., and Nicholas Campos of Patout, Law & Shaw PLLC in Houston.
