HOUSTON — Houston attorneys Benny Agosto, Jr. and Spencer T. Speed of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner, along with co-counsel Nicholas Fleming of Fleming Law, have filed a personal injury lawsuit on behalf of the Mejia family in Harris County, Texas against Harvey-Cleary Builders and Lakey Electric Company, a press release states.
On Aug. 13, 2021, Jose Mejia was severely injured after being electrocuted while working at the POST Houston – the former Barbara Jordan Post Office. Mr. Mejia is an experienced heating, ventilation, and air conditioning (HVAC) technician who was contracted by Harvey-Cleary Builders to provide HVAC services at the POST Houston, which was in the process of being renovated into a mixed-use space, the release states.
At approximately 8 a.m., Mr. Mejia was finalizing the HVAC system in the area designated as the second-floor women’s bathroom when he came in contact with an unsecured live electrical wire sending hundreds of volts of electricity through his body. The result of the electrical shock knocked Mr. Mejia off of his ladder and caused him to forcefully fall to the concrete ground and suffer numerous neurological and nerve disorders, loss of vision, organ damage, and various orthopedic injuries.
Both Harvey-Cleary Builders, as the general contractor of the operation, and Lakey Electric Co, as the responsible party for electrical work and wiring systems, were each responsible for ensuring the electrical wiring/equipment was secured and/or de-energized before allowing workers on the site to perform their duties. Mr. Mejia was not warned, nor did he have knowledge that he would be working in an area with unsecured live electrical equipment that posed an unreasonable risk of harm to his safety.
Mr. Mejia’s injuries were completely avoidable with safe practices. As a result of the electrical shock and fall caused by the negligent practice of Harvey-Cleary Builders and Lakey Electric Co., Mr. Mejia suffered, and continues to suffer, catastrophic injuries that have required significant medical treatment and physical therapy.
Because of his impairment and disability, Mr. Mejia is unable to work to provide for his family. His wife, Marisol Mejia, has taken on two jobs in an attempt to make ends meet, and works around the clock to take care of her husband.
"Mr. and Mrs. Mejia are expected to face a long road of recovery together and bring this lawsuit to recover damages. There is no question that Mr. Mejia’s injuries were caused by Harvey-Cleary Builders and Lakey Electric Co.’s negligent and reckless conduct" said Benny Agosto Jr., attorney for Mr. & Mrs. Mejia.
On Tuesday, Feb. 22, an Original Petition was filed on behalf of Jose and Marisol Mejia against David-Cleary Builders and Lakey Electric Co. seeking damages for Mr. Mejia’s injuries.
