Law Firms Activity Report shows continuing shift to Texas’ Western District for patent litigation

WACO - Lex Machina, a LexisNexis legal analytics company, today released its Law Firms Activity Report, which focuses on firms with the most activity in 16 practice areas over the last three years. 

The report shows filing trends for patent cases continue to shift away from the Eastern District of Texas to the Western District of Texas and the District of Delaware.

“With the rising prominence of the Western District of Texas, many of the most active firms are representing clients in that court,” the report states. “Understanding firm behavior is particularly key in this practice area.” 

According to the report, the top plaintiffs’ law firm for patent litigation was Rabicoff Law with 822 cases filed in the last three years and 51 percent of those cases in either the Western District of Texas or the District of Delaware. 

Sand, Sebolt & Wernow was second with 607 cases, and Devlin Law Firm was third with 588 cases.

According to the report, Fish & Richardson was the top defendants’ law firm for patent cases with 653 appearances in cases filed in the last three years. The cases were spread throughout 38 districts. 

Gillam & Smith was second with 339 cases, and Morris, Nichols, Arsht & Tunnell was third with 310 cases. 

The top three defendants’ law firms all represented multiple tech companies, the report states.
