Houston woman alleges physician's failure to diagnose condition led to loss of vision in eye

HOUSTON — A woman alleges a physician's failure to properly diagnose and treat her eye condition led to the loss of vision in one of her eyes. 

Maria Zapata filed a complaint  March 7 in Harris County District Court against Burt A. Ginsburg, M.D., Burt A. Ginsburg, M.D., P.A., and Retina-Vitreous Associates alleging negligence.

According to her complaint, Zapata began treatment with Ginsburg for diabetic retinopathy. She claims her treatment included injections of Avastin which she first received on Feb. 21, 2020. Zapata alleges that immediately following the injections, she began to experience "severe" symptoms including pain, pressure, discharge, lid crusting and tearing as well as light sensitivity. 

She further alleges that on Feb. 28, 2020, the defendant instructed her to go to the University of Texas Medical Branch Hospital for surgery. She alleges that the defendants' failure to diagnose or recognize her symptoms of ocular pain, refer her to a qualified ophthalmologist and failure to administer intraocular antibiotics caused her endophthalmitis and loss of vision in her left eye.   

Zapata seeks monetary relief of more than $1 million, interest and all other just relief. She is represented by Charles Houssiee, III of Houssiere, Durant & Houssiere LLP in Houston.
