Couple claims landlord's failure to properly fix water leak led to mold exposure

HOUSTON — A couple claims their landlord's failure to properly fix a water leak caused them and their children to suffer from exposure to mold. 

Matthew Spradlin and Madison Vinas filed a complaint  March 14 in Harris County District Court against IT Came To Pass LLC and Alicia Lyles alleging negligence, breach of contract, fraud and other claims. 

According to the plaintiffs' complaint, they entered into a lease agreement with the defendants on Dec. 1, 2019, for a rental property on Elm Lake Lane in Humble. They allege that on Dec. 28, 2020, the defendants worked on a leaky water pipeline at the property underneath the kitchen sink which was not done properly and caused mold growth in the sink area. 

The plaintiffs further allege the mold spread around the property and caused them to have extended periods of "uninhabitable housing." They claim their exposure to mold growth caused them and their children to suffer health and medical issues and that they were forced to find alternative housing including having to pay for hotels. 

The plaintiffs also claim mold testing in December of 2021, found positive findings of mold in multiple areas of the property. Among the plaintiffs' claims against the defendants is that they  failed to disclose facts in order to induce them into staying in the rental property. 

The plaintiffs seek monetary relief of more than $1 million, interest, trial by jury and all other just relief. They are represented by Thaison Hua of Rejas, Hua and Hoang PLLC in Bellaire.
