HOUSTON — A painter alleges his fall was the result of poor training, and a lack of safety protocols on the job site.
Luis Flores filed a complaint April 15 in Harris County District Court against Delux Contractors LLC, Emerson Martinez, Individually and doing business as Delux Contractors LLC , and Alejandra Martinez, individually and doing business as Delux Contractors LLC alleging negligence.
Flores was working for the defendants on July 20,2020, and was involved in painting and other tasks, according to his suit. He claims that while painting, he fell "from a significant height" which caused him to suffer "severe, painful and debilitating" injuries.
He further claims the defendants failed to subscribe to the Worker's Compensation Act and that insufficient training of employees and lack of safety protocols caused an unsafe work environment. Flores alleges the defendants' negligence for failing to provide him with proper equipment, failing to ensure he received proper medical care and failing to warn him of the dangers of painting at an elevated level.
He also claims the defendants failed to provide him with a back-up or relief worker and required him to do physically strenuous work without an appropriate break or assistance.
Flores seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Ian Hernandez and Jimmy Sunosky of Hernandez Sunosky LLP in Houston.
