Lawsuits

DALLAS - A lawsuit has been filed against Luna Express alleging one of the company’s drivers caused an automobile collision.

Alleging negligence, Kenneth Moses filed the suit in Dallas County District Court, seeking monetary relief between $250,000 and $1 million.

According to the lawsuit, on June 15, 2021, Moses was operating his vehicle at the Amazon fulfillment facility in Oklahoma City. Luna Express’ driver, who was operating its tractor-trailer, allegedly failed to keep a proper lookout and struck Moses’ vehicle.

“Following the collision, Defendant’s driver admitted fault. Defendant’s driver apologized to Plaintiff, and he indicated he simply was not looking,” the suit states. “As a result of the collision, Plaintiff sustained injuries, and now brings this lawsuit to recover damages.”

The plaintiff is seeking exemplary damages, as well as damages for his past and future mental anguish, pain, impairment, medical expenses, lost wages and disfigurement.

The plaintiff is represented by attorney Andrew Dao of Daly & Black and attorneys Anthony Akins Pusch and Chi-Hung David Nguyen of Pusch & Nguyen.
