Lawsuit alleges tractor-trailer driver struck vehicle then fled scene

SAN ANTONIO - A recently filed lawsuit is alleging a tractor-trailer struck a vehicle and then drove away from the scene without stopping. 

Seeking more than $1 million in damages, Danny Banda and Veronica Ann Valdez filed suit against Expedited Specialized Carriers and Expedited Specialized Logistics in Bexar County District Court. 

According to the lawsuit, on April 1 the plaintiffs were traveling in a vehicle in the left lane on I-10 when the defendants’ tractor-trailer changed lanes directly into them. 

“Defendants’ driver entirely failed to ensure the lane was clear, and failed to ensure to maintain a proper lookout,” the suit states. “The collision caused Plaintiffs to suffer bodily injuries. The impact also caused Plaintiff Banda to hit his head, sustaining a head injury. After colliding with Plaintiffs’ vehicle, Defendants’ driver callously fled the scene. Plaintiffs now bring this lawsuit to recover damages.”

The plaintiffs are accusing the defendants of negligence, negligent entrustment, negligent hiring, negligent supervision and negligent training. They are also alleging gross negligence. 

The plaintiffs are seeking exemplary damages, as well as damages for their past and future mental anguish, pain, impairment, medical expenses, lost wages and disfigurement.
