North Texas Tollway Authority seeks AG approval to pursue construction defect claim

AUSTIN - The North Texas Tollway Authority has submitted a contingent contract to the Office of the Attorney General for approval in hopes of pursuing a construction defect lawsuit. 

NTTA submitted the request to the OAG on April 27, records show.

According to the approval request, NTTA intends to pursue claims for monetary damages for the purpose of remediating the retaining walls, the Mechanically Stabilized Earth retaining walls in particular, located along an approximately six mile segment of the President George Bush Turnpike between Interstate Highway 20 and Interstate Highway 30 in Dallas County. 

“NTTA’s desired outcome in pursuing the Litigation is to recover Damages owed to NTTA for the failure to properly design and/or construct the subject retaining walls, in addition to other relief allowed under the law,” the request states. 

The law firm of Malouf & Nockels and the Kaeske Law Firm are representing the NTTA, records show.
