Woman alleges defective bed display at Ashley Furniture caused her injuries

HOUSTON — A woman alleges she suffered injuries due to a defective bed display at an Ashley Furniture Store in Houston. 

Elain Philpott filed a complaint May 9 in Harris County District Court against The Dufresne Spencer Group LLC alleging negligence and premises liability. 

Philpott claims she was in the defendant's Ashley Furniture Store at Restaurant Row in Houston on Jan. 27, 2021. She claims she fell due to a defective bed display and suffered injuries including aggravation of prior injuries, impairment, loss of earnings and incurred medical expenses. 

Philpott alleges the defendant failed to maintain their premises in a safe manner and failed to have policies and procedures to direct and train employees on making the premises safe. She also alleges the defendant did not train their employees to prevent accidents and failed to supervise their employees to make sure the premises was safe. 

Philpott further alleges the defendant did not warn of the dangerous condition. 

Philpott seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Abraham Garcia, Carlos Saldana and Brandon Kinard of Abraham Garcia in Houston.
