Man alleges improperly installed handicap bar at Holiday Inn & Suites caused his fall

GALVESTON — A man alleges an improperly installed grab bar in his handicap room caused him to fall and suffer injuries. 

Eddie Davis filed a complaint June 8 in Galveston County District Court against 33rd Street Properties LLC doing business as Holiday Inn Express & Suites and American Liberty Hospitality Inc., doing business as Holiday Inn Express & Suites alleging premises liability.

According to Davis' complaint, he was a guest at the Holiday Inn & Suites on Seawall Boulevard in Galveston on June 24, 2021. Davis, who is wheelchair bound, alleges he was using the bathroom in his handicap room when the grab bar broke free from the wall and caused him to fall to the floor. 

Davis alleges the defendants' failed to maintain their premises, failed to inspect the bathroom and did not properly install the grab bar. He also alleges the defendants failed to warn of the hazard and did not comply with health and safety policies. Davis claims the defendants failed to properly train their employees and agents on inspecting the premises and violated Americans with Disabilities Act guidelines relating to grab bars. He also claims as a result of his fall, he suffered pain, impairment, disfigurement, lost wages and incurred medical treatment costs.  

Davis seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Aaron Conrardy and Joel Hudson of The Hudson Law Firm PC in Carrollton.
