Tenant alleges exposed Comcast cable caused his fall at apartment complex

HOUSTON — A tenant alleges exposed internet cable wiring at his apartment complex caused him to fall. 

David Lastra-Dominguez filed a complaint June 13 in Harris County District Court against Comcast Corporation and Houston Parkwest Place GP LLC alleging premises liability and negligence. 

The plaintiff was walking to his apartment building at Parkwest Place on Westpark Drive in Houston on March, 11, 2022, according to his suit. He alleges that as he got close to his apartment, he slipped over wiring that had been installed by Comcast's employee earlier that morning. The plaintiff alleges he fell to the ground and suffered injuries to his lower back and shoulders.  

The plaintiff claims the defendants failed to maintain their premises in a reasonably safe condition, failed to inspect the premises or warn of the dangerous condition. He further claims the defendants failed to correct the condition and did not train or supervise its employees and subcontractors. The plaintiff alleges he also suffered physical impairment, disfigurement, lost wages and incurred medical expenses as a result of his injuries. 

The plaintiff seeks monetary relief of $75,000 or less, interest and all other just relief. He is represented by Yisroel Lubin of The Daspit Law Firm in Houston.
