GALVESTON — A former worker at an utility contracting company alleges he is owed more than $90,000 in profit sharing in addition to back pay after his employment contract was prematurely terminated.
Eric Dupre filed a complaint June 28 in Galveston County Court against Cruz-Tec Inc., and Andres Cruz alleging breach of contract, fraud and other claims.
According to the plaintiff's complaint, he entered into an employment agreement with Cruz-Tec to help with business development, marketing and other duties. He alleges the agreement included a base salary of $115,00 or $2,212 a week as a 1099 contractor and a four percent share of profits for all projects. Dupre claims that he performed all of the agreed upon work without any complaints from the defendants, who then prematurely terminated the employment agreement.
He further claims he has only received 35 of 52 salary payments and is still owed for his percentage of $2,268,312 in net profits which comes to $90,732.48. Dupre alleges the defendants have failed to provide him with accounting for his share of the profits and are in breach of contract. He also accuses the defendants with fraud for a false promise to pay him a timely annual compensation and profit share.
Dupre seeks monetary relief between $250,000 and $1 million, interest, rial by jury and all other just relief. He is represented by Darrell Apffel, D. Blake Apffel and Jessica Clark of Apeffel Legal PLLC in Galveston.
