Man claims slippery cleaning product on hotel shower caused his fall, sues Holiday Inn Express

HOUSTON — A man claims a slippery cleaning product used on the shower floor in his Holiday Inn Express room caused him to fall and suffer a traumatic brain injury. 

David Stephenson filed a complaint July 11 in Harris County District Court against Brookhollow Hospitality Management LLC doing business as Holiday Inn Express & Suites Brookhollow alleging negligence and other claims. 

Stephenson, according to his complaint, was a guest at the Holiday Inn Express Houston Northwest on Federal Plaza Drive in Houston on June 3, 2022. He claims that morning, as he stepped into the bathtub shower, he slipped and "violently" fell to the floor and struck his head and body on the bathtub side, shower wall and floor. 

Stephenson alleges as a result of his slip and fall, he suffered a traumatic brain injury. He further alleges that he noticed water from the shower beaded and ran on the bathtub floor due to being covered with a cleaning product that was not designed for use in showers and tubs. He also claims the shower did not have any fall protection and that the Holiday Inn Express employees had actual knowledge of the dangerous condition which posed an unreasonable risk of harm. 

Stephenson seeks monetary relief of less than $1 million, interest and all other just relief. He is represented by Court Smith and Caitlin Phillips of Plunk Smith PLLC in Frisco.
