AT&T Texas alleges road construction work caused more than $8,000 in damage to cables

GALVESTON — AT&T Texas alleges an excavation company caused more than $8,000 in damages to their cables at a property in Dickenson. 

Southwestern Bell Telephone Company doing business as AT&T Texas filed a complaint Aug. 2 in Galveston County District Court against Mar-Con Services LLC alleging trespass, negligence and other claims. 

AT&T Texas claims in their complaint that on Aug. 25, 2020, Mar-Con's agents were using excavation equipment during road construction near Calder Road in Dickenson. They allege that during the work, damage was done to their cables despite the cable sites being properly identified, located and marked. AT&T Texas claims Mar-Con was negligent for failing to keep a lookout and exercise proper care while conducting the excavating and failed to determine the proper depth of the cable or conduit. 

They also claim Mar-Con failed to safely operate its boring equipment or call in and wait for utility line location and protect the underground utilities. AT&T Texas alleges Mar-Con was negligent in its training, supervising and hiring of its employees. They claim they have suffered damages in the amount of $8,661.89 and that Mar-Con excavation work at the site was in violation of Texas common law. 

AT&T Texas seeks monetary relief of $250,000 or less, interest and all other just relief. They are represented by Ray Vela of Anderson Vela LLP in The Colony.
