Tenant alleges autistic, blind daughter fell through deteriorated flooring

HOUSTON — A tenant alleges her blind and autistic daughter fell through a deteriorated floor at a residence in Houston. 

Alicia Rockwell filed a complaint Aug. 3 in Harris County District Court against Natpor Properties Inc., alleging negligence. 

The plaintiff, according to her complaint, lived with her legally blind, autistic and non-verbal daughter, A.R., at a residence in Houston. She claims that as A.R. was walking inside the residence, the floor gave way beneath her and caused her to fall into a hole in the floor and suffer injuries. She also claims she suffered injuries while attempting to rescue her daughter out of the hole. 

Rockwell alleges Natpor Properties' negligence for failing to timely address the dangerous condition, failed to warn of the risk and failed to maintain the floor in the residence so that it would not deteriorate. She also alleges Natpor was negligent for failing to inspect the property and that they had actual knowledge of the defective floor and the needed repair. 

Rockwell seeks monetary relief between $200,000 and $1 million, interest and all other just relief. She is represented by Daragh Carter of Smith & Hassler in Houston.
