Bar patron alleges defective staircase leading to outside deck caused his fall

GALVESTON — A patron at a bar in Kemah claims his fall was the result of a defective staircase leading to the outside deck area. 

John Carrio filed a complaint Aug. 15 in Galveston County District Court against Jackie's Brickhouse LLC doing business as Jackie's Bar and Grill and others alleging liability. 

According to his complaint, Carrio was at Jackie's Brickhouse on Marina Bay Drive in Kemah on March 3, 2021. He claims that he tripped and fell down a stairway that led from the inside of the bar to the outside deck area. Carrio further claims his injuries caused him to undergo comprehensive medical treatment including surgery. He alleges the defendants failed to warn of the hazard or use ordinary care in maintaining and inspecting the bar. 

Carrio also alleges the defendants knew or should have known of the dangerous condition posed by the stairway. He claims the stairway was designed, altered or maintained in a manner that posed a tripping hazard. The plaintiff also claims as a result of his fall, he also suffered lost wages, pain, mental anguish, disfigurement and impairment.  

Carrio seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Byron Buchanan of The Buchanan Law Office PC in Houston.
