Construction company faces claim it damaged fiber cable during excavation work

GALVESTON — A construction company is facing a claim that it damaged a fiber company's cable and equipment during excavation work near Gulf Freeway in Dickinson. 

Crown Castle Fiber LLC filed a complaint Aug. 29 in Galveston County District Court against Base Construction LLP alleging trespass and negligence. 

According to their complaint, Crown Castle placed a "hand box and 432-count fiber" on a property near the intersection of Gulf Freeway and FM 517 in Dickinson. They claim they had a right to occupy the portion of the property due to a utility easement and that Base was a subcontractor doing excavation work on a highway project at the location. Crown Castle alleges on Sept. 16, 2020, while doing the excavation work, Base struck and caused $51,138.22 in damage to their property including the hand box as well as underground cable. 

Crown Castle alleges trespass against Base as well as alleges Base's negligence for failing to exercise reasonable care. They claim Base was also negligent for failing to maintain control over their equipment and tools and for not ensuring the dig would not damage or impact the property. 

Crown Castle seeks monetary relief of $250,000 or less, interest and all other just relief. They are represented by Johnathan Groves of The Groves Law Firm PC in Dallas.
