Home Depot customer claims grassy covered hole in parking lot median caused her fall, sues for $1M

GALVESTON — A Home Depot customer alleges a concealed hole in a grassy median caused her fall in the parking lot. 

Danalyn Peters filed a complaint  Aug. 19 in Galveston County District Court against Home Depot USA Inc., alleging negligence and premises liability. 

Peters, according to her complaint, was at the Home Depot store on Gulf Freeway in League City on July 28, 2021. She claims that she parked in a handicapped parking space and stepped onto the grassy median next to the parking space when she stepped into a hole that was concealed by grass. Peters alleges she tripped and fell onto the curb and suffered injuries to her knee and ankle and was transported to the hospital by ambulance. 

Peters claims Home Depot's negligence for failing to maintain its premises in a reasonably safe manner, failing to warn of the hazard and for not properly training their employees on eliminating the dangerous condition. She also claims Home Depot was negligent for failing to take steps to protect invitees from harm, failing to inspect the median and for not eliminating the dangerous condition. Peters further claims as a result of her fall she also suffered mental anguish, impairment, disfigurement and incurred medical care costs. 

Peters seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Matthew Allen and Johnathan Havens of Allen & Havens LLP in Houston.
