Suit alleges minor was robbed, fatally shot in apartment complex parking lot

HOUSTON — The owners of an apartment complex are facing a claim after a minor was robbed and fatally shot on their premises. 

Aster Turcios and Clarissa Guzman, individually and as next of friend of A.T., a minor, deceased filed a complaint Aug. 19 in Harris County District Court against Westdale LLC doing business as The Park at Woodlake alleging negligence.

According to their complaint, the plaintiffs were residents at the defendant's apartment complex. They allege that on May 6, 2022, A.L., was walking in the apartment complex parking lot when he was robbed and fatally shot by an assailant. 

The plaintiffs claim the defendant's negligence for failing to adequately train and supervise its employees on safety and maintenance on the premises, failing to take safety precautions and for not providing a safe and secure environment for its tenants. They also claim the defendant did not properly warn patrons of the hazard and that they knew or should have known of the unreasonable dangerous condition and failed to correct the condition. The plaintiffs allege the defendant was also negligent for failing to inspect the premises. 

The plaintiffs seek monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. They are represented by M. Paul Skrabanek of Pierce Skrabanek PLLC in Houston.
