Construction worker who suffered injuries after scaffolding collapse claims negligence

HOUSTON — A construction worker who suffered injuries after a scaffolding collapse is claiming negligence. 

Jose Valos filed a complaint Sept. 7 in Harris County District Court against Century Communities Inc., and Orlando Flores alleging negligence. 

Valos alleges in his complaint that he was working on the construction of a home in Harris County at the direction of the defendants on April 20, 2022. He claims that the scaffolding he was working on collapsed and caused him to fall to the ground and suffer injuries to his knee and other parts of his body. Valos alleges the defendants' negligence for failing to provide proper equipment including adequate safety equipment and did not inspect the work site for the dangerous condition. He also alleges the defendants did not fix the dangerous condition or warn him of the hazard. 

Valos claims the defendants were also negligent for failing to ensure their worksite was reasonably safe and for knowingly disregarding his safety or following local and federal regulations and ordinances. He alleges as a result of his fall, he suffered impairment, disfigurement, lost earnings and incurred medical and pharmaceutical expenses. 

Valos seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Jason Itkin and Trenton Shelton of Arnold & Itkin LLP in Houston.
