Suit alleges bar owner failed to pay for flooring work

GALVESTON — A contractor alleges he was not paid for his company's work done at a bar in Kemah and suffered injuries from a slip and fall while being threatened to quickly leave the premises.  

Thomas Trevino and Practical Transportation Inc., filed a complaint Sept. 6 in Galveston County District Court against Coco's on the Canal LLC alleging breach of contract. 

According to the plaintiffs' complaint, Trevino, who owns Practical Transportation was hired by Coco's tiki bar in Kemah to install an epoxy floor with sticker artwork. Trevino alleges the sales quote for the project which Coco's accepted was $9097.52. Trevino claims that as Practical Transportation began work on Coco's flooring, there was an agreement for Practical to perform additional work including dock and patio repair, repaving the concrete floor at the front of the bar and tile floor installation. 

He further claims Practical spent 44 days working in Coco's for a total of 262 hours and spent more than $20,000 in labor cost in addition to purchasing more than $30,000 worth of supplies and materials for the job. Trevino alleges that on May 28, 2022, the co-owner of Coco's fired Practical, refused to pay for the project and demanded he and his crew leave the site immediately. Trevino further alleges that due to threats made for not leaving quickly, he slipped and fell into the epoxy and suffered chemical burns on his face, arms and hands as well as suffered injuries to his neck and back. 

Trevino seeks monetary relief of $250,000 or less, interest and all other just relief. He is represented by Attorney Joshua Stein in Houston.
