Merchandiser alleges defective pallet jack at Walmart caused his injuries

HOUSTON — A merchandiser working at a Walmart alleges that the store's poorly maintained pallet jack caused his injuries. 

Kendrick Davis filed a complaint  Sept. 13 in Harris County District Court against The American Bottling Company and Walmart Inc., doing business as Walmart Supercenter #2202, and Manager on Duty alleging negligence.

Davis, according to his complaint, was working for The American Bottling Company as a merchandiser on March 25, 2021. He claims that while at the Walmart Supercenter, he was given a "poorly maintained" pallet jack to move his merchandise which caused him to suffer injuries. 

Davis alleges Walmart's negligence for failing to provide him with safe equipment, failing to inspect the premises and its equipment and failed to properly train him or provide him with sufficient assistance. He also alleges Walmart was negligent for failing to provide him with competent co-employees to peform his job duties safely and for not providing him with medical treatment. Davis claims as a result of his injuries, he suffered physical pain, impairment, mental anguish, loss of earning capacity and incurred medical expenses. 

Davis seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. He is represented by James Grantham of The James P. Grantham Firm PLLC in Houston.
