Houston Mold & Tool worker alleges lack of training, safety caused his injuries

HOUSTON — A worker at a molding and tool business alleges lack of proper training and safety equipment caused his injuries. 

Patrick Smith filed a complaint  Oct. 16 in Harris County District Court against Houston Mold & Tool Inc., alleging negligence. 

Smith alleges that while working for Houston Mold & Tool in Humble, he was injured while torching out a piece of material. He claims he suffered second and third degree burns to his leg. Specifically, Smith claims the material he was working with came in rings and a spiral well and that once you break it from the ring, it springs out about five inches. Smith alleges the ring he was working with sprung out 12 inches due to being welded so tight and caused him to suffer injuries. 

He further alleges he was never properly trained, certified or provided the necessary safety gear or equipment to perform his duties such as goggles, glove or a face shield. Smith claims that even after his injuries, he was asked again to perform the same dangerous tasks without any additional training or proper safety gear. He alleges that when he refused to risk his safety by performing the same task, he was terminated. Smith also alleges that due to Houston Mold & Tool's negligence, he suffered impairment, mental anguish and incurred medical expenses. 

Smith seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Attorney Crystal Wiley in Houston.
