GALVESTON — A League City couple claim construction defects in their home led to extensive mold damage.
Derek Stratford and Amanda Stratford filed a complaint Dec. 7 in Galveston County District Court against Gehan Homes LTD alleging breach of contract, breach of implied warranties and other claims.
According to the Stratford's complaint, they purchased a home in August of 2018, in League City that was built by Gehan Homes. They claim that due to "multiple construction defects," the home had "unacceptably high levels" of humidity and condensation which caused mold infestation. Specifically, the Stratfords claim construction defects caused air infiltration which led to extreme humidity buildup and heightened moisture levels to develop in the house.
They further claim the mold infestation required "extensive" remediation and the replacement and cleaning of their belongings. The Stratfords allege that Gehan's negligence violated the Texas Deceptive Trade Practices Act and that the negligent construction caused them economic damages for temporary housing, engineering and consulting fees as well as the cost of repairs and replacement of their damaged goods.
The Stratfords seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. They. are represented by Dax Faubus of The Faubus Firm in Houston.
