HOUSTON — Harris County residents claim the sellers of a home in Houston refused to make contractual repairs and fraudulently sold the home to other buyers.
Troy Anderson and Shaquita Byrd filed a complaint Dec. 10 in Harris County District Court against Toorka Capital Partners LLC alleging breach of contract, fraud and other claims.
According to their complaint, the plaintiffs entered into a contract for the purchase of a home on Ludington Drive in Houston on Dec. 11, 2020, and paid $2,000 in earnest money. They claim that due to repairs that were needed after a home inspection, the closing date was moved to February 2021, and that a winter storm prior to the closing, caused the homes pipes to freeze and burst.
The plaintiffs further claim the closing was pushed back two additional times due to repairs not being made until June of 2021, when the seller informed them the house would be sold "as is" and the defendants refused to make the repairs according to the contract. The plaintiffs claim they agreed to purchase the home for $30,000 less to cover the needed repairs to the home, however the defendant sold the home to another buyer without refunding their earnest money and in violation of the sales contract.
The plaintiffs seek monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. They are represented by Douglas Alford of The Sanchez Law Firm in Houston.
