Home seller alleges buyer's misrepresentations kept property off market for months

GALVESTON — A Crystal Beach property owner alleges a buyer fraudulently strung him along which kept his home off the market for several months and caused him financial damages after a market downturn.  

Kevin White filed a complaint Dec. 13 in Galveston County District Court against Chicagozie Fawole alleging breach of contract, misrepresentation, fraud and other claims. 

White alleges in his compliant that he accepted a written offer from Fawole on May 7, 2022, to purchase property on O Neal Road in Crystal Beach. He claims that Fawole requested him to extend the closing date for the property in May of 2022, and again in June of 2022. White alleges that Fawole failed to close on the property "without legal excuse" and after nearly three months of delays, she stated she no longer wanted to purchase the property. 

White claims that during the three months that his property was under contract, the market "underwent a dramatic downturn" causing his property to be worth substantially less than the purchase price in his contract with Fawole. He further claims that he relied on Fawole's word which kept him from pursuing other purchases for his property and that her misrepresented intentions caused him to suffer financial damages and that she had no intention of purchasing the contract as agreed in the contract. 

White seeks monetary relief, interest and all other just relief. He is represented by Attorney J.R. Wilson, Jr., in Dallas.
