Estate of minor fatally shot at Houston apartment complex claims negligence

HOUSTON — The estate of a minor who was fatally shot at a Houston apartment complex is claiming negligence. 

Terra White, individually and as administrator of the Estate of Damarion Lewis, filed a complaint Dec. 26 in Harris County District Court against S2 Avalon LP doing business as The Aubrey Apartments and Aubrey 436 Holdings LLC alleging premises liability, negligence, wrongful death and other claims. 

According to the plaintiff's complaint, Lewis was visiting friends at the defendants' apartment complex on Crescent Drive in Houston on Nov. 25, 2022. The plaintiff claims that while in the parking lot helping friends to bring in groceries, Lewis, who was 17 years old at the time, was shot two times by "an unknown assailant." 

The plaintiff alleges that the defendants were aware of the frequent criminal activity near the apartment complex including armed robberies, assault, attempted murder and drive-by shootings. She claims the defendants failed to warn Lewis or have adequate security measures in place such as hiring security personnel to monitor and prevent criminal activity or have gates and cameras.  The plaintiff further claims the defendants attempted to avoid their duty to their residents by "pretending" to be unaware of the criminal acts. 

White seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Taft Foley II of The Foley Law Firm in Houston.
