HOUSTON — A mother whose minor son was fatally shot at a Houston area apartment complex is alleging wrongful death and other claims.
Felicia Gigetts, individually and as administrator of the Estate of Dennis Gigetts and as next friend of A.G., minor, filed a complaint Dec. 24 in Harris County District Court against Plaza At Hobby Owner LP doing business as The Plaza At Hobby Airport Apartments alleging premises liability, negligence, violation of the Deceptive Trade Practices Act and other claims.
According to the plaintiff's complaint, Dennis Gigetts lived with his girlfriend and their minor child at The Plaza at Hobby Airport Apartments on Broadway Street in Houston. She claims that on Aug. 11, 2022, Dennis Gigetts was standing on the sidewalk at the apartment complex when he was fatally shot in the face by an unknown assailant.
The plaintiff alleges the defendants negligently failed to maintain the complex in a safe condition, despite frequent criminal activity, allowed individuals who committed crimes inside the complex and failed to have security guards, gates, cameras and other security measures. The plaintiff claims that prior to Gigetts' shooting, there was other violent criminal activity in the area, including many incidents that were witnessed by their own employees and that the defendants failed to warn of the danger. She further claims the entry gate to the complex was broken at the time of Gigetts' death.
Gigetts seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. They are represented by Taft Foley, II of The Foley Law Firm in Houston.
