HOUSTON — A man alleges he suffered liquid nitrogen chemical burns during a sports cryotherapy treatment.
Jaylen Smith filed a complaint Dec. 22 in Harris County District Court against Sports Cryotherapy of The Woodlands LLC alleging violation of the Deceptive Trade Practices Act.
Smith alleges in his complaint that he was undergoing cryotherapy treatment at Sports Cryotherapy on Sept. 30, 2021. He claims while in the chamber, he was directly exposed to liquid nitrogen when it splashed onto his skin and caused him to suffer chemical burns. He claims the defendant failed to take reasonable steps to ensure the safety of its cryotherapy chamber and did not properly inspect the chamber.
Smith also claims the defendant did not properly respond to the emergency situation and was unable to actively treat his exposure. He alleges the defendants made false representations that its cryotherapy chamber was safe and would provide him with therapeutic benefits. Smith claims as a result of his chemical exposure, he required "extensive" medical treatment, pain, impairment, scarring, lost wages and mental anguish.
Smith seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Brook Akers of The Akers Firm PLLC in Houston.
