HOUSTON — A man alleges contaminated gasoline he purchased from an Exxon/24 Seven station in Houston ruined his vehicle's fuel system.
David Mitchell filed a complaint Dec. 22 in Harris County District Court against Orem Enterprise Inc., doing business as 24 Seven #5 alleging violation of the Texas Deceptive Trade Practices Consumer Protection Act and other claims.
Mitchell, according to his complaint, stopped at the Exxon and 24 Seven #5 on West Orem Drive in Houston on Aug. 28, 2021, and put gas in his Dodge. He claims that while driving home, the vehicle's engine began to have reduced power and that his car to had to be towed to a Dodge dealership on Aug. 30, 2021. Mitchell alleges the gas he purchased at the defendants' station was contaminated and caused "severe damage" to his vehicle's fuel system.
He further alleges the parts needed to repair his vehicle's fuel system were backordered and that his car could not be repaired for two months. Mitchell claims without his vehicle, he was unable to make deliveries to his clients which caused him a loss of business.
Mitchell seeks monetary between $250,000 and $1 million, interest and all other just relief. He is represented by Terry Morgan of The Law Office of John & Morgan PC in Houston and by Attorney Jaison John in Houston.
