HOUSTON — A pipeline worker is claiming negligence after a multi-ton pipeline valve fell on his foot and crushed his toes.

Adam Michael Durand filed a complaint Jan. 9 in Harris County District Court against Townsend Well Control LLC, Townsend Well Control Rm LLC and The Kiss Group LLC doing business as TKG Energy.

Durand, according to his complaint, was working at Townsend Well Control's facility on May 7, 2022. He claims that while working underneath a multi-ton pipeline valve, the large magnet used to lift the valve did not lock in place which caused the pipeline to fall on his foot and crushing his toes. Durand alleges his pinky and ring toe had to be amputated and that he required additional foot surgery.

He claims the defendants were negligent for failing to provide safe equipment and a reasonably safe job site, Durand also claims the defendants were negligent for failing to have adequate safety policies and procedures, failed to supervise and properly train workers and for violating OSHA regulations. He alleges that also as a result of his injuries, he has incurred medical treatment costs, lost earnings and has suffered mental anguish.

Durand seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Jason Gibson, Casey Gibson and Andrew Becker of The Gibson Law Firm in Houston.
