HOUSTON — A worker who fell through a hole on the roof at a school construction project is claiming negligence.
Jose Manuel Hernandez filed a complaint Jan. 27 in Harris County District Court against Divisionone Construction LLC and Vogler Sheet Metal Co., Inc., alleging negligence.
Hernandez, according to his complaint was installing weatherproof paper and roofing tar on a roof at a school construction project in Sugar Land on May 16, 2022. He claims that he suddenly fell through a hole that had been cut in the roof in preparation for the AC unit to be installed and suffered a fractured femur, fractured wrist, torn ligaments in his knee and other injuries.
Hernandez alleges that his employer at the time did not provide Workers' Compensation and paid him in cash. He claims the defendant's negligence for failing to comply with safety regulations, provide proper equipment or training and failed to eliminate the hazards on the job site. Hernandez also claims he was not warned about the dangerous conditions and that the hole in the roof was not blocked off or barricaded. He alleges he also suffered lost wages, disfigurement, mental anguish and incurred medical care expenses.
Hernandez seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Steve Kherkher, Ryan MacLeod and Omar Chawdhary of Kherkher Garcia LLP in Houston.
